King’s Magic Entertainment commits to honor all the terms and conditions stated on this agreement (specified location, time and services)
King’s Magic Entertainment will maximize its efforts to provide equipment which is in good working order.  In the event that King’s Magic Entertainment is unable to perform the above services due to any unforeseeable malfunction of its equipment, sickness or accident of the entertainers, unavailability of replacement staff or if a performance is prevented, rendered impossible or unfeasible due to any cause beyond the control of King’s Magic Entertainment, it is understood and agreed that there shall be no claim for damages by either party to this contract and King’s Magic Entertainment’s obligation to perform such services shall be waived.  In the event one of the events contemplated above occurs, all deposits money shall be returned in full.
CANCELLATION POLICY:
Should the person booking the party have to postpone the booked entertainment, it will be re-scheduled for another date and time suitable to all parties involved. Should the person booking the party cancel the performance at any time after the booking is made, the full fee will be due and payable upon cancellation.
The client must ensure that the location at which King’s Magic Entertainment is to provide the services agreed upon has all necessary electrical outlets, electrical fixtures, electrical service capacity or related devices or capacities to allow King’s Magic Entertainment equipment to be installed and function properly.
King’s Magic Entertainment reserves the right to substitute entertainers of the same caliber when necessary.
If for any reason King’s Magic Entertainment is unable to perform the services contracted above due to any act of oversight or any negligence on the part of the client, or due to the breach of any term of this agreement, all deposit money or forfeit and any balance that would have been due upon full performance of the services contracted shall immediately become due and payable not withstanding King’s Magic Entertainment’s inability to perform its obligation pursuant to this agreement.
King’s Magic Entertainment will not be liable in any way for personal injuries or damage to the property of the client, the client’s guests, invites, agents, employees, contractors or any other person save and except for such injuries or damages as are caused by the gross negligence of King’s Magic Entertainment in the performance of the services contracted above.  In any event, the liability of King’s Magic Entertainment shall not exceed the contract price, and it is expressly agreed that King’s Magic Entertainment shall in no event be liable for special, indirect or consequential damages.
The client agrees to indemnify and save harmless King’s Magic Entertainment for any and all liability with respect to the injuries and damages referred to in the proceding paragraph, including damages to King’s Magic Entertainment equipment, save and except to the extent that such damages are the direct result of the gross negligence of King’s Magic Entertainment in the fulfillment of its obligations hereunder and, in any event, for all liability in excess of the contract price.
All changes to the terms printed on this contract must be initialed by both parties in print copy.  The person booking entertainment will receive a copy of this booking ageement that must be signed and faxed back within 24hr of submiting this agreement in order to firmly reserve your show date.
